DMCA Policy for Cauliflower Rice
Cauliflower Rice ("we", "us", "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.
If you are a copyright owner or an agent thereof and believe that any content hosted on Cauliflower Rice infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
Filing a DMCA Notice of Alleged Infringement
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of the material that you claim is infringing and where it is located on the Cauliflower Rice website (e.g., URL, specific page title, etc.).
- Contact information of the complaining party: Your name, address, telephone number, and email address.
- Statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
- Electronic or physical signature: A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent containing the following information (see 17 U.S.C 512(g)(3) for further detail):
- Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or access to it was disabled.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Contact information of the counter-notifying party: Your name, address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Cauliflower Rice may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or physical signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we may, at our sole discretion, restore the removed material after 10 business days unless the copyright owner files an action seeking a court order to restrain the user from engaging in infringing activity.
